These Terms of Use ("Terms") govern your access to and use of Ekameva Visitor Tracker ("EVT," "the Service," "we," "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
EVT is a website-visitor tracking service. Customers install a script on their own website(s), which collects data about visitors to that site (IP-based and, where permitted, precise geolocation; device and browser information; pages visited; and related signals used to distinguish human visitors from bots). EVT filters likely bot/automated traffic and delivers reports of human visits to the Customer by email and/or webhook, on a schedule the Customer chooses.
2. Eligibility & account responsibility
- You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
- You are responsible for keeping your account credentials and API key confidential, and for all activity that occurs under your account.
- You must provide accurate registration information and keep your domain(s) and contact details up to date.
3. Acceptable use
You agree that you will:
- Only install the EVT script on websites you own or are authorized to monitor.
- Comply with all applicable laws regarding the collection of visitor data, including providing any disclosures or obtaining any consents required in the jurisdictions where your visitors are located (for example, under GDPR, CCPA, or similar laws). You, not EVT, are the data controller for visitor data collected through your website, and you are responsible for your own privacy policy and compliance obligations toward your visitors.
- Not use the Service to collect data about visitors in a way intended to harm, discriminate against, stalk, or harass any individual.
- Not attempt to circumvent plan limits, share or resell API keys, or use the Service to monitor a domain you have not registered it for.
- Not attempt to interfere with, reverse-engineer, or disrupt the Service's infrastructure, including attempting to probe, scan, or overload our systems.
We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.
4. Plans, billing & cancellation
- New accounts receive one month of full Pro-tier access at no charge. After that period, continued use of paid features requires an active subscription.
- Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan you select) via our payment processors (Stripe, PayPal, and/or Razorpay, depending on your region).
- You may cancel your subscription at any time from your dashboard; cancellation takes effect at the end of the current billing period, and you will not be charged again after that. Except where required by law, fees already paid are non-refundable for partial billing periods.
- We may change our pricing or plan features with advance notice. Continued use of the Service after a pricing change takes effect constitutes acceptance of the new pricing for your next billing cycle.
- If a payment fails, we may downgrade your account to the Free plan or suspend paid features until payment is resolved.
5. Data ownership & your data, your responsibility
As between you and us, you retain ownership of the visitor data collected through your sites. We process it solely to provide the Service to you (see our Privacy Policy for details on what is collected and how it is handled). You are responsible for ensuring your use of that data - and any decisions you make based on it - complies with applicable law.
6. Service availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. Bot-detection accuracy, geolocation precision, and third-party services we depend on (geolocation providers, mapping providers, email delivery, and payment processors) may occasionally be delayed, inaccurate, or unavailable, and we are not liable for losses arising from such interruptions.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT BOT DETECTION WILL BE 100% ACCURATE, OR THAT GEOLOCATION DATA WILL BE PRECISE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EKAMEVA AND ITS OWNERS/OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your failure to comply with applicable data-protection laws with respect to visitors to your own website(s).
10. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service (in which case we will provide reasonable notice where practicable).
11. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless otherwise required by applicable local law where you reside.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
